The present general terms and conditions of sale apply between,

owner of the online sales site www.woolinspires.com
hereinafter referred to as "WoolInspires", and
on the other hand, natural persons who are not traders and who wish to make a purchase on the WoolInspires website, hereinafter referred to as the "Customer".
The "Customer" and "WoolInspires" are collectively referred to as the "Parties".
The Parties agree that the applicable general terms and conditions of sale are those made available to the Client on the www.woolinspires.com website when the order is placed. If a condition should be lacking, it would then be governed by the practices in force in the distance selling sector.
Compagnie des Laines sàrl currently only offers its products for sale within the European Union and Switzerland. However, on request, Compagnie des Laines sàrl can examine a delivery to another country.
The present general terms and conditions of sale define the contractual relations between the Parties and in particular the placing of the order, the payment procedure, the confirmation of the order, the delivery, the guarantee and any exchanges.
Customers acknowledge having read these general terms and conditions of sale when placing their orders and declare that they accept them without reservation.
Orders for items offered for sale on the website www.woolinspires.com can be placed via the website's automatic registration system or by sending a message to the email address [email protected]. Any order on the basis of another purchase order or an incomplete purchase order cannot engage WoolInspires.
Any order implies the acceptance without reserve of the particular conditions of sale specific to each of the items ordered (name, price, colour, weight, quantity, shipping costs or other particularities) and of the description of the ordered item as indicated on the website.
The contract of sale between the Client and Woolinspires resulting from an order placement only becomes perfect once full payment has been validated.
For a sale outside the EU and Switzerland, a prior request must be addressed to [email protected]. The sale becomes perfect only after discretionary agreement of WoolInspires to deliver in the country indicated by the Client and the validation of the full payment of the order.
Any order as well as its shipment will be confirmed by Woolinspires via the mode of order chosen by the Client. The invoice is also a confirmation of the order.
Woolinspires reserves the right to refuse any order from a Client with whom a dispute exists.
PRICES AND SHIPPING COSTS
All prices are indicated in euros, all taxes included (VAT), excluding shipping costs. Any change in the VAT rate will be automatically reflected in the sales prices. Woolinspires reserves the right to modify the prices of the items offered on its website at any time. Invoicing is made according to the prices in force at the time of the order.
The shipping costs are indicated on the site and their cost is displayed when the order is registered. They include packaging, handling and postage costs.
The Customer must provide a valid delivery address. In the event that the address provided does not allow the order to be properly delivered and the order is returned, the Customer shall be responsible for resending the package.
TAXES AND CUSTOMS DUTIES
For deliveries within the EU, the invoice will be issued with the VAT rate of the Grand Duchy of Luxembourg. For deliveries outside the territory of the EU, the invoice will be drawn up exclusive of tax, and in this case, customs duties, local VAT and other taxes and formalities applicable to the import of the item ordered are the sole responsibility of the Customer, who undertakes to check the possibilities of importing the items into his country of delivery.
METHOD OF PAYMENT
Payment must be in euros and can be made by credit card (via Mollie B.V.) or bank transfer. In case of payment by credit card, the Client's banking information is never communicated to Woolinspires but is processed directly via the secure and encrypted payment module of the Mollie B.V. transaction company. The Client will have to enter his details and credit card information on the secure Mollie B.V. website. Woolinspires reserves the right, in order to verify the validity of the payment, to proceed to the debit of the credit card as soon as the order is validated by the Customer.
In case of payment by bank transfer, the transfers must be stipulated free of charge for the beneficiary company Woolinspires.
RESERVATION OF OWNERSHIP
The price of the items ordered is payable when the order is placed.
The goods remain the property of Woolinspires until full payment of the sales price, including shipping costs.
Woolinspires undertakes to deliver the items ordered as soon as possible but no later than 30 days after validation of payment, postmark as proof.
In case of order of an article out of stock, the Customer will be informed at the latest within 7 days after placing the order.
The delivery times displayed on the website are given for information only and may vary depending on the item ordered and the destination of the shipment. Exceeding them cannot give rise to any cancellation of the order, price reduction or damages.
In principle, the items ordered are delivered in a single consignment unless the Customer has opted to receive them in several consignments as and when the items become available. This option gives rise to an additional invoicing of the shipping costs according to the rates in force for each shipment, each considered as an individual order.
Deliveries are made by an independent carrier and against acknowledgement of receipt. In the event of absence at the time of delivery, a delivery notice will indicate where to collect the parcel. In case of non withdrawal by the Customer of his order during the conservation period of the carrier, the ordered items are returned to WoolInspires. The order will then be cancelled and the Client will be refunded the selling price minus the shipping and return costs which will remain at the Client's expense.
The Client will have to provide a valid delivery address. If the address provided does not allow the proper delivery of the order and the return of the order, the reshipment of the package will be at the expense of the Client.
The risks incurred by the goods during transport are in all cases borne by the Customer. Woolinspires cannot be held responsible for any delivery problems, loss or deterioration of the goods. In case of loss or damage an investigation will be requested from the carrier and in the case of compensation according to the carrier's general conditions, this will be paid back to the Client in the form of a refund.
WoolInspires does not incur any obligation of delivery for orders whose payment could not be validated.
WoolInspires can not be held responsible for any non-performance that would have for origin a case of force majeure, including, in particular, stock shortages, interruptions of transport or problems of import or export.
RIGHT OF WITHDRAWAL
The Customer has a right of retraction allowing him to return the items ordered without giving reasons and without penalty. This right of retraction must be exercised within 10 days from the date of receipt of the order. The return shipment must be sent before the expiry of this period, the carrier's stamp being proof. This right of retraction cannot be exercised for magazines, patterns, electronic files (download), articles made at the Customer's request or made to the Customer's specifications.
If the right of retraction is used, the Customer must return the goods at his own expense in perfect condition, without traces of use, unopened, unsealed or damaged (after contact with a smoking environment, the goods can no longer be sold) and in their original undamaged packaging. In order to certify the date of return, the Customer is invited to return the goods by registered or tracked mail.
Before returning the goods, the Customer agrees to inform Woolinspires by sending an email to [email protected].
Woolinspires is not responsible for errors of information transmitted by the Customer at the time of his order, nor for the use that is made by the Customer or a third party of the ordered items.
Woolinspires is not responsible for the risks related to the use of the internet (virus, phishing etc).
Woolinspires strives to deliver items to its Customers in excellent condition. The Customer is invited to check the good condition of his goods as soon as he receives them. In the case of a package damaged or opened during transport, the Customer must imperatively notify info@woolinspires within 48 hours of any reservations related to the delivery.
Any complaint relating to the invoicing or delivery of goods must be notified to info@woolinspires by post within 10 days of receipt of the goods by the Customer. After this period, Woolinspires will no longer be obliged to accept claims related to the goods or the invoice subject to the provisions of the legal guarantee.
Subject to the availability of items, Woolinspires undertakes to replace at its expense as soon as possible the items that do not conform to their description on the website www.woolinspires.com or to the item indicated in the order provided that they have been notified and returned within 10 days in perfect condition, without traces of use, unsealed, unopened, unopened or damaged (attention after contact with a smoking environment the goods can no longer be sold) and with their original packaging undamaged.
Any complaint must be sent in writing by post to the address Compagnie des Laines sàrl, 78 bd Napoléon 1er, L-2210 Luxembourg. The return costs for goods that have been the subject of a complaint within the above-mentioned period will be reimbursed to the Customer.
METHOD OF REIMBURSEMENT
After use of the right of withdrawal or after acceptance of the complaint, the Customer shall be reimbursed as soon as possible and at the latest within 30 days after receipt of the returned goods. The Client shall be reimbursed by re-crediting his credit card (if the card allows it) or by bank transfer, in which case the Client shall be required to provide Woolinspires with his bank details (IBAN no. and BIC code).
Woolinspires shall be entitled to deduct from the price to reimburse the possible costs of returning the goods except in case of guarantee or accepted claim.
Woolinspires controls the quality of the products sent by its producers. However, Woolinspires cannot control the quality of the totality of its articles without the risk of damaging and altering the products themselves as well as their packaging. Consequently, Woolinspires cannot guarantee that the balls of wool and cotton and other items offered on its website are free of defects. In particular because of the manual manufacturing and the artisanal colouring of the wools and cottons, WoolInspires does not guarantee the perfect correspondence of the colours, dimensions and weight of the balls offered for sale.
The Customer benefits from the seller's legal guarantee and all other provisions provided for by the law of 21 April 2004 relating to conformity as well as the provisions of the Luxembourg civil code relating to the guarantee of critical flaws.
In order to benefit from the legal guarantee, the Customer is obliged to denounce to WoolInspires, by any means, the lack of conformity within 2 years from the reception of the goods.
The website www.woolinspires.com is the exclusive property of Compagnie des Laines. The general architecture, its content, articles, texts, illustrations, images, sounds, trademarks and logo are reserved under copyright and are the exclusive property of WoolInspires or are subject to an authorization of use for the benefit of WoolInspires.
Any total or partial use, copy, reproduction, publication, downloading, display, transmission or diffusion of the site without the prior authorization of WoolInspires or the holders of the rights is prohibited and will be considered as an infringement of intellectual property. A link of the hypertext type to the site is however authorized without specific request if it is made for information purposes.
APPLICABLE LAW AND LEGAL COMPETENCE
The present general conditions and the contract between the Client and WoolInspires resulting from an order of articles, are governed by the law of the Grand Duchy of Luxembourg. Any dispute relating thereto is the exclusive jurisdiction of the courts of the city of Luxembourg without prejudice to the right of WoolInspires to bring the dispute before any other competent court.
PROTECTION OF PERSONAL DATA
Personal information communicated on the www.woolinspires.com website is processed in accordance with the Luxembourg law of 2 August 2018 on the protection of individuals with regard to the processing of personal data. In accordance with this law, the Customer has the right to access, modify, rectify and delete data concerning him/her. These rights can be exercised by sending a letter by post to the head office of Compagnie des Laines.
Woolinspires undertakes not to communicate the details of its Clients to third parties without their authorisation, with the exception of third parties intervening in the execution of orders (carrier, banking service).
In the exceptional case of non-payment or fraud in the means of payment, WoolInspires reserves the right to communicate all necessary data to the police, competent jurisdictions and collection agencies.
Any cause conceded as null or void by a change in law or jurisprudence will be considered as unwritten. This shall not affect the validity of the other clauses of the present general terms and conditions of sale.
